1. Agreement to Terms
These Terms of Service ("Terms") are a binding agreement between you and Victory Pro Deck Builders ("Victory Pro," "we," "us," or "our") covering your use of www.victoryprodeckbuilders.com (the "Site"), any quote requests, calls, text messages, emails, and other communications between you and our team. By using the Site, submitting a quote request, or communicating with us, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or submit information to us.
These Terms do not govern the actual construction of any project you hire us to build. Construction work is governed by a separate written contract signed by both parties.
2. Who We Are
Victory Pro Deck Builders is a Florida-licensed and insured general contractor building custom decks, pergolas, outdoor kitchens, and pools for homeowners across Broward, Miami-Dade, and Palm Beach Counties.

3. Use of the Site
You must be at least 18 years old to use this Site, submit a quote request, or opt in to SMS or email communications from Victory Pro Deck Builders. By using the Site or providing your contact information, you represent that you are 18 years of age or older.
You may use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You agree not to:
- Submit false information, impersonate another person, or use the Site to harass anyone.
- Attempt to reverse-engineer, scrape, or interfere with the Site.
- Use the Site to send spam, viruses, or any malicious code.
- Copy or reuse Site content (photos, copy, designs, project images) without written permission.
4. Quote Requests and No-Cost Estimates
Quote requests submitted through the Site are inquiries only. Submitting a request does not create a contract or binding obligation. We will follow up to discuss your project, and any actual work will only proceed after a separate written agreement is signed.
All quotes are estimates. Final price depends on site conditions, materials selected, permitting, and any change orders, all of which are documented in the project contract.
5. Communications Consent (Calls, Texts, and Email)
When you submit a form, call us, or otherwise provide your contact information, you consent to receive communications from Victory Pro Deck Builders at the phone number(s) and email address(es) you provided, including by automated means. Communications may include calls, recurring text messages, and emails about your quote, scheduling, project status, invoices, and occasional promotional offers. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of texts at any time.
SMS / Text Message Program Terms
The following terms govern our SMS messaging program. They are mirrored in our Privacy Policy.
- Program: Victory Pro Deck Builders SMS Alerts
- Message types: Quote follow-ups, appointment confirmations, project scheduling, status updates, crew arrival notifications, invoice or payment reminders, and occasional promotional messages.
- Message frequency: Varies based on project stage. Most contacts receive 2 to 8 messages per month. Active customers may receive more during scheduling and build phases.
- Cost: Message and data rates may apply. Victory Pro does not charge you for SMS messages, but your wireless carrier's standard rates may apply.
- Opt-in: You opt in by (a) submitting our quote form, (b) verbally consenting on a recorded call, (c) replying to a Victory Pro text, or (d) handing your number to a Victory Pro team member with a request to be contacted by text.
- Opt-out: Reply STOP to any SMS message to opt out. You will receive a one-time confirmation that you have been unsubscribed.
- Help: Reply HELP for assistance, or call 954-806-4364.
- Carriers: Supported on all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
- Privacy: See our Privacy Policy. We do not sell, rent, share, or otherwise disclose mobile phone numbers or SMS opt-in data to third parties or affiliates for marketing or promotional purposes.
Phone Calls
By providing your phone number, you authorize Victory Pro Deck Builders and our agents to call you at that number, including by automated dialing systems and prerecorded voice messages, regarding your quote, project, scheduling, and related services. This consent applies even if your number is on a state or federal Do Not Call list. Consent is not a condition of any purchase. You can withdraw call consent at any time by telling any Victory Pro representative.
By providing your email address, you authorize us to send transactional emails (quote, scheduling, invoicing, project updates) and, if you opt in, occasional marketing emails. You can unsubscribe from marketing emails at any time using the link in any marketing email.
6. TCPA Compliance
Victory Pro Deck Builders complies with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, applicable Florida consumer-protection law, and CTIA messaging principles. Our SMS program is approved through registered carrier campaigns under the A2P 10DLC framework. If you believe we have contacted you in error or after an opt-out, email ariel@victoryprodeckbuilders.com with the subject line "Stop Contact" and we will remove your information.
7. Intellectual Property
All content on the Site, including text, photos of completed projects, design renderings, logos, and the Victory Pro Deck Builders name and brand, is owned by Victory Pro Deck Builders or used with permission. You may not copy, reproduce, modify, or republish any of it without our written consent.
8. Reviews and Submissions
If you post a review, send testimonials, or share photos with us, you grant Victory Pro Deck Builders a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt that content for our marketing, website, and social media. You confirm that any content you share is yours to share and does not violate anyone else's rights.
9. Third-Party Links
The Site may link to third-party sites (review platforms, manufacturers, suppliers). We do not control and are not responsible for the content, accuracy, or practices of those sites.
10. Disclaimers
The Site is provided "as is" and "as available." We make no warranties of any kind, express or implied, regarding the Site's operation, accuracy of information, fitness for a particular purpose, or non-infringement. Project descriptions, timelines, "before and after" examples, and pricing references on the Site are illustrative and do not constitute a binding offer. Actual project terms are governed solely by your signed construction contract.
11. Limitation of Liability
To the maximum extent permitted by law, Victory Pro Deck Builders is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, your communications with us, or your reliance on Site content. Our total liability for any claim related to the Site is limited to one hundred U.S. dollars ($100). This limitation does not apply to obligations under a signed construction contract.
12. Indemnification
You agree to defend, indemnify, and hold harmless Victory Pro Deck Builders, its owners, employees, and subcontractors from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of (a) your misuse of the Site, (b) content you submit, or (c) your violation of these Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute related to the Site or these Terms shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes are posted means you accept the updated Terms.
15. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.
